40. The Committee recommends to the State party to ensure that, in which a person deprived of liberty does not consent to the sharing of information about the deprivation of liberty, the duty of confidentiality and the right to privacy be fulfilled in a manner that respects the conditions set forth in article 20 of the Convention. Furthermore, the Committee urges the State party to guarantee the right to a prompt and effective judicial remedy as a means of obtaining without delay the information referred to in article 18 (1) of the Convention. This right may not be suspended or restricted under any circumstances, as provided for in article 20.
