The Committee welcomes the draft Children´s Act which aims at stronger guarantees for children´s best interest assessments and their right to express their views and be actively involved in decisions affecting them, especially in custody and visitation cases. It also welcomes measures to reduce conflict between parents during separation, including promoting mediation and co-parenting agreements. The Committee recommends that the State Party ensure legal safeguards for children at risk of harm in situations of parental conflicts, including by ensuring thorough individual assessments of the child’s best interests based on interdisciplinarity expertise.
